    Frequently Asked Questions

Conveyancing is the legal title transfer of property or land from one individual or entity to another. It’s a comprehensive and often complex legal process, but an essential one when purchasing or selling property.

The conveyancing process for buying and selling are different, both with different steps and requirements. As a starting point, we recommend speaking with one of our expert conveyancers before you buy or sell. We offer free contract reviews for all Settle Easy customers who are buying. Reviewing the Contract of Sale will make sure you’re informed so there are no hidden surprises come settlement.

Our expert conveyancers are ready, prepared to answer any questions you have about transferring ownership of property or about conveyancing in general. Our conveyancing services are available across Australia, from Victoria to Queensland to New South Wales. Whether you’re selling an investment property or buying your first home, we’re here to help you throughout your journey.

Property conveyancers handle many of the legalities of purchasing and selling property. They take care of the legal documents and contracts associated with property transfer and real estate transactions, ensuring the process goes smoothly, that clients’ rights are protected, and each party gets the results they are entitled to. Many conveyancers will even help coordinate communications with your real estate agent and bank or financial institution to ensure the entire process proceeds efficiently. Our conveyancers will keep you informed throughout the whole conveyancing process, helping you understand your legal obligations and the decisions you will need to make for property settlement.

Buying or selling property is a massive decision and shouldn’t be taken lightly. And while many have tried to do their own conveyancing, there is a lot that can go wrong if you don’t have the required legal knowledge and experience. Not to mention the hours of legal work that go into preparing property contracts and other documentation.

Instead of trying to work everything out yourself, a qualified property conveyancer can provide you with everything you need to smoothly transfer property from one party to another. Additionally, conveyancers have the protection of professional indemnity insurance, which in turn protects you. Our property conveyancers work hard to simplify the settlement process, explaining legal jargon and ensuring you know what’s happening at each stage. This way you get a seamless and stress-free conveyancing experience.

Conveyancing costs and conveyancing fees will vary from conveyancer to conveyancer, as there are a wide range of optional services you may need as part of the conveyancing process, in addition to legal fees. The scope of work that a conveyancer undertakes, and the associated costs, will depend on the complexity of the property transaction. Their work will involve carrying out all the relevant searches and preparing all relevant settlement documents. As the potential new owner of the property, you need to know about any information regarding debt attached to the property, known issues with the property itself, and other risks before purchase.

The types of searches your conveyancer may recommend include:

    • Title Search
    • Local Authority Searches
    • Risk Assessments
    • Structural Search
    • Pest Reports
    • Strata

Stamp duty, also known as transfer duty, is a tax paid on the acquisition of property. Whether you’re buying a property or receiving it as inheritance or a gift, there’s a very good chance you’ll need to pay stamp duty.

Stamp duty is calculated based on the purchase price or the market value of the property, whichever is higher at the time of  acquisition. Regardless of whether you think you’ll need to pay stamp duty or not, it’s a good idea to calculate it. For a stamp duty estimate, use our stamp duty calculator or talk to our team today.
