Frequently Asked Questions
At a basic level, conveyancing is the process of transferring property or land ownership from one person or entity to another.
Whether you’re buying or selling residential or commercial property, you will have to go through the conveyancing process. It involves a conveyancer or experienced property lawyer completing a series of checks, searches, certificates and other tasks to make sure every part of a property is in order before settlement.
Some of the tasks our conveyancers carry out include:
- Checking the contract of sale
- Checking if there are any outstanding debts or encumbrances on the property
- Searching for and ordering title documents from the Land Registry Office
- Carrying out searches including council and water rates searches, planning and heritage searches, and title and encumbrance searches
- Taking water meter readings
- Acquiring Environment Protection Authority (EPA) certificates.
When you acquire a property, there’s an important, once-off tax called stamp duty added to the initial costs.
Regardless of whether the property was bought, gifted, or inherited, you will need to pay stamp duty. The cost of stamp duty will vary depending on the property’s market value or how much you paid for it, whichever is higher.
Most of the time, you won’t be able to avoid paying stamp duty. There are certain Government schemes that you may be able to take advantage of to waive stamp duty, but you will need to make sure you’re eligible first.
We recommend finding out how much stamp duty will cost you regardless, as it will help you plan things properly. For an estimate of how much stamp duty might cost you, try our stamp duty calculator. Alternatively, book a call with our experienced conveyancers and we can step you through this part of your property journey.
Conveyancing isn’t a “one size fits all” service. No two properties are the same, which means no two conveyancing services are the same. We tailor all our services to meet our customer’s needs and ensure they get a fair price for conveyancing.
All our prices are outlined upfront and they’re fixed, ensuring you know exactly what you’re paying for. There are no hidden costs or unexpected fees. Everything is clearly set out from the very beginning.
While we do charge additional amounts for out of pocket expenses, also known as disbursements, we’ll let you know what we’re expecting these items will be upfront.
Want to know more about the cost of our conveyancing services? Just give us a call and our friendly conveyancers can help you. If you’re already a customer with us, we’ll be happy to take you through these costs line by line, so you know exactly what you’re paying for.
For a general estimate of our conveyancing fees use our Conveyancing Calculators. Or get in touch with our team and we can provide you with an accurate quote for your conveyancing matter.
We provide conveyancing services for a range of property types and structures, including homes and businesses in the Northern Beaches. If you’re not sure whether we can assist you with your specific property, give us a call and our team will be able to help you.
We offer conveyancing services for the following property types:
- rural property and residential conveyancing
- commercial property conveyancing
- large scale ‘off the plan’ property developments
- retirement village residences
- properties within trust structures
- properties for self-managed superannuation funds (SMSFs).
When you hire a Settle Easy conveyancer, they will carry out a series of tasks, checks and searches to ensure everything is in order with the property. We’ll also take care of communication between parties.
Our conveyancer may undertake some or all of the following tasks:
- council and water rates searches
- planning and heritage searches
- title and encumbrance searches
- water meter readings
- road authority certificates
- land tax clearance certificates
- Environment Protection Authority (EPA) certificates
- owner’s corporation/body corporate/strata title certificates.
Although it is possible to complete your own conveyancing, it is a complex process and there are risks involved. That’s why we recommend that you seek out professional conveyancing services to finalise the sale or purchase of your property to ensure the smooth and successful completion of your transaction.
Because conveyancing is a legal process, everything must be done according to the letter of the law. If you were to make a mistake, it could end up costing you much more than you bargained for in time, expenses – even mental anguish.
Our lawyers and conveyancers are also covered by professional indemnity insurance to give you complete peace of mind throughout your property journey.
We want to see all our customers settle easy – ask us how we can help you today.
