Frequently Asked Questions
A conveyancer, also known as a conveyancing lawyer or solicitor, is simply a property transfer specialist. They prepare the legal documents that form part of real estate transactions including the purchase and sale of properties, settlements and title transfers.
Our conveyancing lawyers handle the entire conveyancing process, including all the necessary paperwork and documentation, legal searches and associated communications to deliver a stress-free conveyancing service.
Whether you are buying or selling property, there are many steps involved in the conveyancing process.
That’s why it is important to engage property law experts like Settle Easy to guide you every step of the way.
And because there are a number of steps involved in conveyancing, there are also a lot of conveyancing questions our local Toowoomba conveyancers get asked.
- stamp duty concessions
- PEXA fees
- buying property off the plan
- conveyancing fees
- what being ‘under contract’ really means
- the Contract of Sale for House and Residential Land
- what a vendor is
- buying at auction
- your settlement date
- building and pest inspections
- residential property and commercial property matters
- professional standards legislation.
Buying or selling property is not cheap. It’s why the team here at Settle Easy works so hard to keep our conveyancing fees low and affordable. However, every conveyancing matter is unique because every property is different.
When you contact us, our team will assess your needs and come up with a tailored, fixed price quote for your conveyancing matter. This price includes all the fees for our core service and it is fixed, meaning it won’t change after your initial quote. There are no hidden fees and if there are any additional disbursement costs we’ll provide you with an estimate of how much these will be before you lock us in.
For a rough price estimate, use our Conveyancing Calculators. But if you’re looking for an accurate quote, contact us today to book a time with our conveyancers and we’ll be able to help you out.
One of the things we get asked about most is stamp duty. While it’s an essential part of dealing with property, it’s not something that often gets explained, as it can be somewhat complex depending on the transaction.
Simply put, stamp duty is a tax payable on transactions involving property, based on the purchase price or value of the property. Property isn’t the only thing affected by stamp duty, but it is one of the most common things this duty is payable on. The amount of stamp duty you’ll need to pay will depend on the type of transaction and its value.
Depending on your situation, you may be eligible for a stamp duty concession. You can claim a first home concession for transfer duty when acquiring your first residence if you meet certain requirements.
The first home stamp duty concession only applies to a home valued under $550,000 and can save you up to $15,925. The home concession may still apply for a home valued over $550,000.
You do not have to be an Australian citizen or permanent resident to claim a concession, but you must meet the eligibility criteria. Additional foreign acquirer duty may apply if you are a foreign person.
To find out if you are eligible for a stamp duty concession and to work out how much you’ll need to pay, a great place to start is the Queensland Government website that covers all this. Alternatively, reach out to a conveyancing solicitor on our team today and we’ll be able to answer all your questions.
